Terms of Service

1. Acceptance of terms

By using AvaTransfer (the "Service") you fully accept these Terms of Service. If you do not accept, do not use the Service.

2. Service description

AvaTransfer is a file transfer platform that allows users to upload files and share temporary download links with recipients via email or direct link.

3. User account

Account registration is optional. Registered users have access to additional features (transfer history, higher quotas). Users are responsible for keeping their credentials confidential.

4. User content

The user warrants that they own or have the right to upload transferred files. It is forbidden to upload:

  • Illegal, offensive, defamatory, pornographic content or content inciting violence
  • Content violating third-party intellectual property rights
  • Malware, viruses or malicious code
  • Content subject to international sanctions or embargoes

The Controller reserves the right to remove infringing content and suspend repeat offenders' accounts.

5. Expiration and deletion

Uploaded files have a default lifespan (configurable). Upon expiration, they are automatically deleted. Expired files cannot be recovered.

6. Limitations

The Service is provided "as-is". The Controller does not guarantee:

  • Uninterrupted Service availability
  • Absence of errors or interruptions
  • Recovery of files deleted due to expiration or malfunctions

The user is responsible for preserving original copies of files.

7. Limitation of liability

To the extent permitted by law, the Controller is not liable for direct, indirect or consequential damages arising from Service use, including data loss.

8. Privacy

Personal data processing is described in the Privacy Policy.

9. Changes to terms

The Controller may modify these Terms at any time. Changes become effective upon publication. Continued use of the Service constitutes acceptance of new terms.

10. Applicable law

These Terms are governed by Italian law. Disputes fall under the jurisdiction of the Controller's competent court.
